1. About this website
MDP Surfaces Inc. ("MDP", "we", "us") operates this website to present our collections, catalogues, project inspiration and resources, and to receive inquiries and sample requests. These terms concern the website. They do not, by themselves, form a sales contract or impose purchase obligations.
2. Inquiries, samples and orders
Product listings invite you to contact us; they are not binding offers, stock reservations or order confirmations. Sending a form, requesting a sample or receiving an automated acknowledgment does not confirm an order, reserve a slab or guarantee sample availability.
Prices, quantities, specifications, delivery arrangements and other transaction terms must be confirmed with MDP. An accepted written quotation, confirmed order or separate signed agreement governs the relevant transaction, together with applicable law. These website terms do not amend that agreement or create payment, cancellation or return fees. We may correct website errors prospectively, subject to applicable advertising and consumer laws; corrections do not unilaterally change an existing contract.
3. Product appearance and backlighting
Slabs may differ in colour, veining, pattern and finish, including between production batches. Samples and photographs illustrate appearance but cannot show every part of a full slab. Screen settings, photography and lighting also affect perceived colour. Where practicable, review the actual slab and proposed layout with your supplier or fabricator before fabrication.
UHD-908 and UHD-903 are translucent. Backlit photographs illustrate possible effects. The result depends on the selected slab, thickness, lighting colour and placement, backing and installation. Discuss the proposed assembly with qualified professionals and, where appropriate, evaluate a mock-up. These observations do not excuse defects, misdescription or failure to meet agreed specifications, or limit legal warranties.
4. Project planning and installation
Website inspiration and general care information do not replace project-specific technical advice, current product documentation or applicable building and safety requirements. Qualified professionals must verify measurements, intended use, supports, substrate, fabrication methods, handling and installation for the particular project. Follow applicable workplace controls for cutting, grinding and dust exposure.
Each professional remains responsible for their own work and obligations. Nothing here transfers MDP's own legal responsibilities to a customer or installer or limits applicable product liability.
5. Warranties and product concerns
Consult the written residential and commercial warranties available on our Resources page for their respective coverage and conditions. These terms do not add to, replace or reduce those warranties. Mandatory legal warranties and remedies also remain available where applicable, including rights relating to ordinary use, reasonable durability, hidden defects and conformity with representations.
Contact MDP promptly with product concerns and relevant order details or photographs. Doing so helps us investigate; this request does not impose a shorter legal claim period or make your statutory rights conditional on a particular form.
6. Content and intellectual property
Website text, photographs, designs, graphics, logos and catalogues belong to MDP or their respective rights holders. You may view, download and share MDP-owned materials for a genuine product inquiry or project evaluation, retaining attribution and copyright notices. Reuse of third-party materials is subject to the relevant rights holder's permission or terms and any applicable legal exceptions. Other commercial reproduction, republication, resale or use of our branding requires the rights holder's prior written permission, except as permitted by law. No ownership or general trademark licence is granted.
7. Responsible use
Provide accurate information and submit only material you are entitled to share. Do not impersonate others, send unlawful or infringing content, introduce malicious code, interfere with the website, bypass access controls or use automated extraction that disrupts service or commercially reproduces protected content without authorization. Ordinary search-engine indexing is permitted.
We may proportionately restrict access to address misuse, security threats or legal requirements. Send project information only as needed; our Privacy Policy describes how personal information is handled.
8. External websites and service providers
External links are provided for convenience. Their operators control their own content, services and policies, so review them before using those services. A link does not itself endorse every statement or offering on an external website.
Normandin Systems designs, develops, hosts and manages this website as a website service provider. That role does not make Normandin Systems the seller, manufacturer or installer of MDP slabs, or a party to a product purchase.
9. Website availability and liability
We take reasonable care with the website, but maintenance, outages and errors may occur. Subject to mandatory law, we do not promise uninterrupted or error-free access. Contact us to confirm information material to your project.
The following commercial-loss exclusion applies only to business users. It does not apply to consumers, including Québec consumers.
To the extent permitted by law, MDP is not liable to business users for indirect or consequential commercial loss resulting from website use or unavailability, such as lost business opportunities. This exclusion concerns the website only and does not limit obligations under a product transaction.
Nothing in these terms excludes or limits liability for intentional or gross fault, bodily or moral injury, or any liability, warranty or remedy that cannot lawfully be excluded or limited.
10. Business-user responsibility for third-party claims
This section applies only to business users and does not apply to consumers.
To the extent permitted by law, a business user must reimburse MDP for reasonable, documented losses and defence costs arising from a third-party claim, but only to the extent caused by that user's unlawful website misuse or culpable infringement of another person's rights. This does not cover MDP's own fault. MDP will give reasonably prompt notice and a reasonable opportunity to participate in the defence. Neither party may agree to a settlement imposing an admission or obligation on the other without that party's written consent.
11. Updates and applicable law
We may revise these website terms by publishing a dated version and drawing attention to material changes on this page. Revisions apply prospectively, subject to any legally required notice or consent, and do not alter existing orders or accrued rights.
Québec law and the applicable laws of Canada govern, subject to mandatory protections and court rights available in your place of residence. These terms require no arbitration and waive no class-action rights. French is available alongside other languages; no English-language priority overrides applicable language rights.
If a provision is unenforceable, the remaining provisions continue where legally possible. Failure to enforce a provision is not a continuing waiver. Any lawful assignment remains subject to applicable law and cannot reduce mandatory rights.
